Privacy policy

How JS Highway Transport Pty Ltd handles personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

1. About this policy

JS Highway Transport Pty Ltd ("we", "us", "our") provides road freight transport services in Western Australia. We respect your privacy and handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in that Act.

This policy explains what personal information we collect, why we collect it, how we use and disclose it, how we keep it secure, and how you can access it, correct it or make a complaint. It applies to this website and to our dealings with customers, suppliers, contractors and enquirers.

2. What personal information we collect

We collect only the personal information reasonably necessary for our functions and activities as a freight carrier. That typically includes:

  • Contact and identity details — your name, business name, position, email address and any telephone number you choose to provide.
  • Consignment details — pickup and delivery addresses, site access instructions, contact names at each end, freight descriptions, dimensions, weights and any special handling or dangerous-goods information.
  • Delivery records — signatures, names and times recorded on consignment notes and proof-of-delivery documents.
  • Account and billing information — billing addresses, purchase order references and payment records.
  • Correspondence — the content of emails and enquiry forms you send us, including any information you volunteer in them.
  • Technical information — limited information generated when you visit this website, as described in section 6.

We do not seek sensitive information as defined in the Privacy Act. Please do not send us sensitive information unless we have asked for it and you have consented to providing it.

3. How we collect personal information

Wherever it is reasonable and practicable, we collect personal information directly from you — when you email us, submit the freight enquiry form on this website, place a booking, sign a consignment note, or correspond with us about a job.

We may also collect personal information from third parties where that is necessary to carry out a delivery. For example, a consignor may give us the name and contact details of the person receiving the freight, or a site operator may provide induction and access contacts. If we collect your details from someone else, we take reasonable steps to make you aware of this policy.

4. Why we collect, hold, use and disclose it

We use personal information for the purposes for which it was collected and for directly related purposes you would reasonably expect, including to:

  • prepare quotes and respond to freight enquiries;
  • arrange, schedule, perform and confirm the carriage of goods;
  • communicate with consignors, consignees and site contacts about collection and delivery;
  • issue invoices, process payments and manage accounts;
  • keep records required for load restraint, mass and dimension, permit and other regulatory obligations that apply to heavy vehicle operations;
  • investigate and resolve service issues, damage claims and complaints;
  • meet our obligations under Australian law.

We do not sell personal information, and we do not use it to send marketing material unrelated to a job you have enquired about or booked.

5. Who we disclose information to

We may disclose personal information to:

  • Parties to the consignment — consignors, consignees and their nominated site contacts, so freight can be collected and delivered.
  • Subcontracted carriers and depots — where part of a movement is performed by another operator, limited to what that operator needs to complete the task.
  • Port, terminal and site operators — where access, slot bookings or site inductions require it.
  • Professional and service providers — our accountants, insurers, legal advisers and IT or email service providers, bound by confidentiality obligations.
  • Government agencies and regulators — where disclosure is required or authorised by law, including in connection with heavy vehicle compliance or a lawful request.

Overseas disclosure. We do not routinely disclose personal information to overseas recipients. Some of the email and website hosting services we rely on may store data on servers located outside Australia. Where that occurs, we take reasonable steps under APP 8 to ensure the recipient handles the information consistently with the Australian Privacy Principles.

6. This website and cookies

This website is a static site. It does not use advertising trackers, analytics scripts, social media pixels or third-party content delivery networks, and it does not set marketing or profiling cookies.

Our hosting provider may automatically record standard technical information in server logs — such as IP address, browser type, the pages requested and the date and time of the request — for security, abuse prevention and reliability purposes. Where an IP address can identify an individual it is treated as personal information under this policy.

The freight enquiry form on our contact page opens your own email application. It does not transmit your details to a third-party form processing service; your enquiry is sent to us as an ordinary email.

7. Data quality and security

We take reasonable steps to ensure the personal information we collect, use and disclose is accurate, up to date and complete. Please tell us if your details change.

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include restricting access to records to people who need it for their work, using access-controlled email and business systems, and securing physical documents such as consignment notes.

No method of transmission or storage is completely secure. If we become aware of a data breach that is likely to result in serious harm, we will assess and respond to it in accordance with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act 1988.

8. How long we keep information

We retain personal information only for as long as it is needed for the purposes described in this policy, or for as long as we are required to keep it by law. Transport, taxation and business records are generally retained for at least seven years. Enquiries that do not become jobs are deleted once they are no longer of use. When information is no longer required, we take reasonable steps to destroy it or to de-identify it.

9. Access and correction

Under APP 12 and APP 13 you may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading.

To make a request, email [email protected]. We may ask you to verify your identity. We will respond within a reasonable period, usually within 30 days. Access is free, although we may charge a reasonable cost for supplying copies of extensive records. If we refuse access or correction, we will tell you why in writing and explain how you may complain.

10. Anonymity and pseudonymity

Under APP 2 you may deal with us anonymously or under a pseudonym where it is lawful and practicable. In practice this is rarely workable for freight bookings, because collection, delivery, invoicing and regulatory record-keeping all require identifiable contact details.

11. Complaints

If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please contact us first at [email protected] with the details. We will acknowledge your complaint, investigate it, and give you a written response — normally within 30 days.

If you are not satisfied with our response, you may refer the matter to the Office of the Australian Information Commissioner (OAIC), which is the independent regulator responsible for privacy in Australia. The OAIC can be contacted by post at GPO Box 5218, Sydney NSW 2001, or by telephone on 1300 363 992.

12. Changes to this policy

We may update this policy from time to time to reflect changes in our practices or in the law. The current version is always published on this page, and the date at the top of this page shows when it was last revised. Material changes take effect when they are published here.
